Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Rely Mortgages but by your lawyers. Some firms on the Rely Mortgages will charge an ‘acting for lender’ fee and others do not.
I am about to exchange contracts on a purchase with a mortgage from Rely Mortgages. The report from my solicitor mentions that Rely Mortgages could withdraw their offer before completion. Is this right?
Banks and Building Societies such as Rely Mortgages can revoke their mortgage offer although this rarely happens. In the unlikely event that Rely Mortgages withdraw their offer they may or may not inform you or the lawyer as to their reasoning. There are various possible reasons but here are a few examples:
- Many mortgage offers have an expiry date. Your lawyer should check this. Rely Mortgages may amend or withdraw an offer before the end of its validation period if an offer extension is requested and following a re-evaluation of the property the value of the security is below a level which is acceptable to them.
- If the borrower informs Rely Mortgages of a change in the loan amount agreed
- Following advice from the valuer on their lender panel or If the lender has doubts about the effectiveness of the valuation as a result of subsequent events or information received post valuation but pre completion
- Where the lender has to take account a recent change in law
- Where the Lender’s right to possession is fettered in some way
Intending to buy a house with a mortgage with Rely Mortgages. I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Building Society if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the Rely Mortgages conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the Rely Mortgages conveyancing panel
